In a case in the juice industry, Baker defended Paradise Splash against various intellectual property claims, including trade secrets, and the settlement for a fraction of the damages sought was paid by insurance and “this outcome allowed my client to continue building his business,” said Baker.
Baker said the value of patents is declining in favor of the value of trade secrets. “The cost of litigation continues to escalate based on the ever-expanding volume of available information. Discovery processes meant to conserve resources usually only increase cost and delay litigation, which results in more cost.”
